So, what do you think? Is the ICC Prosecutor just looking at Iraq in order to move away from her African focus?
To fill the gap that may be left if African countries do not want to have their cases brought to the ICC? Or is there enough evidence about crimes there – maybe committed by British forces – that will force the ICC to investigate?

And Chantal Meloni at Opinio Juris asks whether – like her predecessor Luis Moreno Ocampo – Bensouda will find it too “uncomfortable” an investigation to take up. But Mark Kersten on his blog Justice in Conflict points out that “there are those who believe that the Court can only survive in any meaningful way if it investigates and prosecutes Western officials.”Republish
